• "Delivery Day": means Tuesday or Wednesday, the days we operate delivery services.

3. Use of Website and Portal

3.1 Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately of any unauthorized use of your account.
• You must be at least 18 years of age to create an account.

4. Service Description

4.1 Coverage Area

We provide delivery services to 104 postcodes across Perth, Western Australia. Coverage areas are assigned to either Tuesday or Wednesday delivery zones. You can submit deliveries for both zones if your business requires it.

4.2 Delivery Schedule

• Delivery Days: Tuesday and Wednesday only.
• Submission Deadline: 7:00 AM on the delivery day for same-day delivery.
• Recommended Submission: The day before delivery for guaranteed capacity.

4.3 Refrigerated Transport

All deliveries are transported in refrigerated vehicles. We maintain appropriate temperature controls for fresh produce, flowers, and temperature-sensitive goods.

5. Email Verification

Upon registration, you will receive a verification email. You must verify your email address to activate full account functionality. Failure to verify your email may result in limited access to services.

6. Intellectual Property

6.1 Our Content

All content on the Portal, including text, graphics, logos, software, and design, is owned by The Giving Goods Delivery Co and protected by Australian and international copyright laws.

6.2 Your Content

By uploading delivery information to the Portal:

• You grant us a license to use, process, and store the information to provide our Services.
• You represent that you have the right to share all uploaded information.
• You remain responsible for the accuracy of all information provided.

7. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Australian Privacy Act 1988 (Cth).

8. Third-Party Integrations

8.1 Xero Integration

We offer optional integration with Xero accounting software. By connecting your Xero account:

• You authorize us to create invoices in your Xero account.
• You grant us access to your Xero contact and transaction data as needed to provide our Services.
• You acknowledge that Xero's terms of service also apply to your use of their platform.

8.2 Shopify and WooCommerce

We may support integrations with e-commerce platforms. You are responsible for ensuring your use of these platforms complies with their respective terms of service.

9. Limitation of Liability

9.1 Service Availability

While we strive for continuous availability, we do not guarantee that the Portal will be available at all times. We may suspend access for maintenance, updates, or unforeseen circumstances.

9.2 Delivery Information

You are responsible for the accuracy of all delivery information submitted. We are not liable for failed or incorrect deliveries resulting from:

• Incorrect recipient addresses.
• Incorrect phone numbers.
• Incomplete delivery instructions.

9.3 Maximum Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from these Terms or our Services shall not exceed the total fees you paid to us in the three months prior to the claim.

10. Indemnification

You agree to indemnify and hold harmless The Giving Goods Delivery Co, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your breach of these Terms.
• Your violation of any law or third-party rights.

Before initiating legal proceedings, you agree to attempt to resolve any disputes through good-faith negotiation. If negotiation fails, disputes may be referred to mediation before litigation.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Terms of Service, constitute the entire agreement between you and The Giving Goods Delivery Co regarding use of the Portal and Services.
